Modern Solution Realty Inc., Brokerage (“Modern Solution”, “we”, “us”) is committed to protecting the personal information of the people we serve. This policy explains what we collect on modernsolution.ca and in the course of our real estate services, why, and the choices you have. It is written to meet the Personal Information Protection and Electronic Documents Act (PIPEDA), Canada’s Anti-Spam Legislation (CASL) and the record-keeping duties of the Trust in Real Estate Services Act, 2002 (TRESA).
What we collect
Information you give us: your name, email address, telephone number, city or property address, and anything you write in a form, chat window, email or call — for example when you ask for a home evaluation, request a showing, register for an account or apply to join the team.
Information about your use of the site: pages viewed, the listings you save, the links you click, approximate location derived from your IP address, browser and device type, and the campaign or search that brought you here (for example UTM parameters and advertising click identifiers).
Transaction information when you become a client: identification and other details we are required to collect and keep under TRESA, FINTRAC anti-money-laundering rules and our brokerage agreements.
How we use it
To respond to your enquiry, set up a listing or buyer search, arrange showings and provide brokerage services you ask for.
To send you market updates, new-listing alerts and information about our services when you have asked for them. Every marketing email includes an unsubscribe link, and you can withdraw consent at any time by using it or by contacting us.
To measure and improve the website and our advertising, using analytics and advertising cookies described below.
To meet legal and regulatory obligations, including record retention required by RECO and FINTRAC.
Who we share it with
Service providers who help us operate: our customer relationship management (CRM) system, email and hosting providers, analytics and advertising platforms (Google, Meta), and the listing data systems of the real estate boards we belong to. These providers may process data outside Canada, including in the United States, and are bound by contract to protect it.
Other parties to a transaction when you are our client — for example the other brokerage, your lawyer, lender, home inspector or appraiser — as needed to complete the transaction and as set out in your representation agreement.
Regulators, courts and law enforcement where the law requires it. We do not sell personal information.
Cookies and tracking
We use first-party cookies and local storage to keep you signed in, remember your saved listings and preferences, and remember where you first landed so we can credit the right campaign if you contact us.
We use Google Ads and Meta (Facebook) tags to measure whether our advertising leads to enquiries, and Google Analytics-style measurement to understand how the site is used. You can decline non-essential cookies in the banner shown on your first visit, and you can clear or block cookies in your browser at any time; some features, such as saved listings, may then stop working.
How long we keep it
Enquiries and marketing records are kept while we have a relationship with you and for a reasonable period afterwards. Transaction records are kept for the minimum periods required by TRESA and FINTRAC (generally at least six years after the transaction). Analytics data is retained according to the settings of the platform that collects it.
Your rights and choices
You may ask to see the personal information we hold about you, ask us to correct it, or withdraw consent to its use (subject to legal and contractual limits) by emailing [email protected] or writing to us at 3466 Mavis Rd Unit 1, Mississauga, ON L5C 1T8. We respond within one business day, usually the same day.
If you are not satisfied with our response you may contact the Office of the Privacy Commissioner of Canada at priv.gc.ca.
Security
Personal information is stored on access-controlled systems, transmitted over encrypted connections and limited to staff and providers who need it. No method of transmission or storage is completely secure, and we will notify you and the Privacy Commissioner of any breach that creates a real risk of significant harm, as the law requires.
